NOTICE OF CLASS ACTION SETTLEMENT ISSUED TO MORE THAN 40,000 TRUCK DRIVERS FOR PRIME, INC.

Truck drivers who trained with and/or drove for Prime, Inc. have the opportunity to recover money in class action settlement in Dominic Oliveira and Rocky Haworth, et al. v. New Prime, Inc., D. Mass. Civil Action No. 1:15-cv-10603-PBS.

This lawsuit alleges that Prime, Inc. violated the Fair Labor Standards Act and state wage and hour laws by failing to properly pay trainees and its employee drivers and independent contractors.

Persons who may be eligible are the following:

“All individuals who have attended training to become truck drivers for Prime and/or have driven for Prime as employee drivers and/or as independent contractor drivers who have leased their trucks through Prime at any time from October 2, 2012, to May 8, 2020, and all individuals who have otherwise attended training in Missouri to become truck drivers for Prime at any time from March 4, 2010, to May 8, 2020 (the “Class Period”), except for the named plaintiffs in Montgomery v. New Prime, Inc., 8:17-00321 (C.D. Cal.).”

To settle this lawsuit, Prime agreed to pay a total of up to $28,000,000.00 to the Class members and to waive its claims for reimbursement for training costs and other debts owed by the Class members, along with other non-monetary benefits. All Class members will recover automatic settlement payments and additional amounts by filing claims.

PRIME, INC. ORDERED TO TAKE CORRECTIVE ACTION AFTER SPREADING FALSE INFORMATION ABOUT SETTLEMENT NOTICE

Immediately after the Court-approved notice was sent by email and mail to more than 40,000 potential class members, a Prime, Inc. supervisor sent a message to all drivers, stating that the email settlement notice was a “phishing scam” and that drivers should not click on the settlement website. This information was completely false.

At an emergency hearing on October 9, 2020, the Court expressed serious concerns about this inaccurate message and ordered that Prime:

  1. send a message to all drivers explaining that the first message was inaccurate and explaining how drivers could participate in the settlement;
  2. pay for notice to be sent by first-class mail to all drivers who had received email notice and include in the notice an official letter from Prime explaining the mistake; and
  3. request that a message explaining the mistake be posted on Prime driver Facebook groups.
